Is it twilight for the late, great Supreme Court of the United States?
During oral arguments this week on 303 Creative LLC v. Elenis, Justice Samuel Alito made jesting comments about Black shopping mall Santas and kids in Ku Klux Klan outfits. His disgraceful snideness is unbecoming and diminishes the dignity of a court already on the skids.
A more serious flaw was Justice Barrett's disgraceful coaching of attorney Kristen Waggoner for 303 Creative LLC, to deflect argument away from protected status to message as the basis of the suit, thus preventing Waggoner's case from exploding. There is no better example of an "activist judge" in operation, allowing neither facts nor precedent to matter if they obstruct conservative ideological extremist ends. The Court, as in the Roe v. Wade decision, is trampling stare decisis under foot in a rush to advance a prejudiced and narrow view of the issues involved.
The court is losing legitimacy in the eyes of Americans as it is no longer serves its proper role as an advocate and defender of human rights, but instead serves as a fawning shill for minority sectarian bigotry hiding behind the skirts of religion. But then religion has been used as a bogus justification for all manner of inhumanities for centuries.
Lauren van der Post, South African writer and humanist once said, “Organized religion is making Christianity political rather than making politics Christian.”
If the former is the aim of a conservative court, then it is hitting a bullseye on the target; if the latter, it is coming up embarrassingly short of the mark. Either way, it should come as no surprise that many Americans have little or no respect left for what is obviously an extremely biased institution sorely in need of major reform. It is an Augean stable in need of a Herculean cleansing .
