Dear, Dear 1/6 Select Committee [1]

Yes, I'm speaking to all of you.

People panned your prospective criminal referrals to the Department of Justice for people you believe committed crimes related to the insurrection that culminated in an armed, violent attack on the Capitol, but I encourage you to go forward with those referrals.

Too many commentators claim that such referrals would carry no weight with the DOJ. They are steadfastly missing the point.

First, this an important way to pierce the fallacy bubble around the right-wing universe. Try as they might to protect their weak-minded voters, the anti-America crowd will not be able to keep them from finding out about the referrals.

Second, the DOJ isn’t obligated to file criminal charges against someone just because Congress accuses them of a crime. They are, however, obligated to investigate, just like they are obligated to investigate when anyone provides credible evidence of a crime.

Third, the inhabitants of the DOJ are big boys and girls. So, if they whine about political pressure from these referrals, I’m going to laugh at them.

However, to ramp up the pressure on DOJ to take these seriously and act on them, I suggest they use the following form:

This committee has uncovered probable cause that person X committed crime Y.

Then, attach the evidence.

That means that unless the DOJ is willing to turn a blind eye to the evidence they take that evidence in front of a grand jury and seek an indictment.

For example, there is evidence that Donald J. Trump committed conspiracy to materially interfere with a congressional proceeding, the Electoral Vote count. The evidence is that he worked with others in a scheme to send unqualified votes to that count. (And, of course, there’s plenty of other evidence, which should be added here.)

Just go down the list of people you have evidence against and create the kind of referral you’d make to a grand jury. Because if you put in everything the DOJ would use to go to a grand jury, and they don’t, then there’s going to be a very, very difficult question for them to answer: “Why not?”
