True Justice. Finally.
For decades, conservative justices have made a specific point to support many of their rulings on race: They insist that the Constitution is entirely “colorblind,” prohibiting any consideration of race under all circumstances. During oral arguments in Merrill v. Milligan on Tuesday, a case they will attempt to use to eradicate what remains of the Voting Rights Act, they advanced this theory once again. This time, however, Justice Ketanji Brown Jackson refused to cede ground to their revisionist history. In a series of extraordinary exchanges with Alabama Solicitor General Edmund LaCour, Jackson explained that the entire point of the 13th, 14th, and 15th Amendments was to provide equal opportunity for formerly enslaved people, using color-conscious remedies whenever necessary to put them on the same plane as whites. It was a masterclass in progressive originalism that illustrated exactly why Jackson is such a crucial addition to this ultra-conservative court. ...And Jackson was having none of it. “I don’t think we can assume that just because race is taken into account, that that necessarily creates an equal protection problem,” Jackson told the Alabama solicitor general. “I understood that we looked at the history and traditions of the constitution, at what the Framers and the Founders thought about. And when I drill down to that level of analysis, it became clear to me that the Framers themselves adopted the equal protection clause, the 14th, the 15th Amendment, in a race-conscious way. That we were, in fact, trying to ensure that people who had been discriminated against, the Freedman, during the Reconstruction period, were actually brought equal to everyone else in society.”

Kenya’s rising climate star tells how her speech at Cop26 grabbed a world leader’s attention, and urges policymakers to go beyond mere pledges. At last November’s UN climate change conference (Cop26) in Glasgow Wathuti’s speech enumerated the struggles low-income countries face feeding their populations due to the climate crisis. “As we sit comfortably here, more than 2 million of my fellow Kenyans are facing climate-related starvation. In this past year, both our rainy seasons have failed and scientists say that it may be another 12 months before the water returns again. Meanwhile, our rivers are running dry, our harvests are failing,” she said. “Our store houses stand empty. Our animals and people are dying.” Her speech caught the attention of the US president. “I saw Biden’s security team trying to signal to the president that it was time to leave but he waved them off. He wanted to listen. Perhaps I had something he really needed to hear,” she says.

Meanwhile, “Not my President” Elon Musk managed to say some incredibly stupid things on Twitter, of all places, offering a peace plan that basically let’s Putin get away with way too much (although I’m sure in his naiveté he didn’t see it that way). This is the best explanation I’ve seen as to why Putin “wants to negotiate” and Ukraine isn’t interested:

You may not be aware, but the UK is doing one of the single STUPIDEST “climate actions” ever conceived (even stupider than “carbon capture” — even stupider than “clean coal”, and that’s saying something). They are cutting down forests, grinding them up into wood pellets, shipping them across the ocean, and then BURNING THEM as “renewable energy”.
Here’s the result:
A company that has received billions of pounds in green energy subsidies from UK taxpayers is cutting down environmentally-important forests, a BBC Panorama investigation has found… Ecologist Michelle Connolly told Panorama the company was destroying forests that had taken thousands of years to develop. "It's really a shame that British taxpayers are funding this destruction with their money. Logging natural forests and converting them into pellets to be burned for electricity, that is absolutely insane," she said. ... Panorama wanted to see if logs from primary forests cut down by logging companies were being transferred to Drax's Meadowbank pellet plant. The programme filmed a truck on a 120-mile round trip: leaving the plant, collecting piles of whole logs from a forest that had been cut down by a logging company and then returning to the plant for their delivery.

The campaign season is in full swing… And thanks to some amazingly bad Maga candidates, chances of holding the Senate are looking better and better:
Herschel Walker says he doesn’t know his accuser. That’s weird. It’s the mother of one of his kids. She spoke out today, and she has a lot to say. The woman, a registered Democrat whose years-long relationship with Walker continued after the abortion, told The Daily Beast that her chief concern with revealing her name was because she is the mother of one of Walker’s own children and she wanted to protect her family’s privacy as best she could while also coming forward with the truth. (Walker has publicly acknowledged the child as his own, and the woman proved she is the child's mother and provided credible evidence of a long-term relationship with Walker.) After Walker denied the report, one of his three sons, conservative social media influencer Christian Walker, released a series of angry statements and videos condemning his dad as a liar, and alleging that the University of Georgia football hero had threatened to murder him and his mother—Walker’s ex-wife.
Moving on to Pennsylvania, where Dr. Oz is looking more and more like Dr. Frankenstein:
Columbia's internal investigation found that Oz's research team inflicted extensive suffering on canine test subjects in violation of the Animal Welfare Act. In a scandal that will surely make Mitt Romney—who famously strapped his family dog atop the roof of his car for a road trip—look like a PETA activist, a review of 75 studies published by Mehmet Oz between 1989 and 2010 reveals the Republican Senate candidate’s research killed over 300 dogs and inflicted significant suffering on them and the other animals used in experiments. ...Dog abuse allegations against Oz are a drop in the candidate’s proverbial bucket of scandals at this point—but given the all-American tradition of loving dogs more than humans, it might be hard to brush this one under the rug.

Meanwhile, Trump’s appointee to head the World Bank, David Malpass, has been taking heat over his inability to admit that climate change is a thing, while shunting billions in investment dollars to egregious fossil fuel projects that are locking us in to accelerating climate chaos.
Funding for “upstream” oil and gas projects from the World Bank was meant to stop from 2019, but the Big Shift Global, a coalition of more than 50 NGOs, has found the bank and its subsidiaries funding oil refinery and gas processing since then. As the bank is also instrumental in helping to catalyse investment from other donors and the private sector, its direct funding of $14.8bn to fossil fuel since the Paris agreement is likely to be the tip of the iceberg when it comes to assistance to high-carbon development, according to the report published on Thursday. ...Last month, Malpass refused to affirm climate science when confronted by a journalist. Though he subsequently sought to clarify his position, the former US vice-president Al Gore has called for his resignation, and the White House “condemned” his words. The Guardian also understands that several leading governments are engaged behind the scenes in exploring ways in which he could be removed from post.

In the department of “This is absolutely disgusting but of course we should have expected it:
In addition to the regular questions about allergies, asthma, chronic illness, and other medical issues, the form—which was obtained by a number of local news outlets—also includes five questions specifically for “females only” that ask about their menstruation history. They ask about things like the student’s first period, the typical length of their periods, and the time between periods… The problem stems from the state’s recent move to storing the forms digitally, meaning they’re hosted by a third party. Additionally, according to The Palm Beach Post, “all of that medical data is then turned over to the athlete’s school, contrary to other states that require only the physician’s signature page to clear them to play.” In our post-Roe v. Wade reality—and especially in a red state like Florida with an aggressively anti-abortion legislature—this is exactly the sort of scenario that raises red flags. Sharing this medical information with schools (which are typically not constrained by HIPPA privacy rules) is bad enough, but hosting them on a third party brings up even more valid privacy concerns. According to The Florida Times-Union, the app in question (Aktivate) says it doesn’t sell or share student information, but it is subject to subpoena and government enforcement proceedings… We have already seen how this sort of information can be used by law enforcement to investigate potential miscarriages or abortions.
