I’ve been going through old writing I did looking for submissions for a grad program. One of the papers I came across was a bench memo. In it, the defendant had called and said he was suicidal. Police responded and helped him to a hospital. They conducted a search of his apartment b/c he said he had a gun- they found weed. I prosecuted him for the weed and submitted the memo supporting the search opposing a motion to suppress. I think my memo legally was correct, but missed the point by a mile.
To state the obvious, I was so very very very wrong. At this point in my life, I don’t care if you sleep on bales of marijuana and subsist on THC gummy bears. But, I locked up someone who called for help. I can’t undo that. With the perspective that now that I’ve called for help for myself, the last thing I want is another person checking a dresser drawer before they call for help. In those moments, seconds count.
I wish I could say I have any recollection of this case. I don’t. It was doing the work and being right on the law and being wrong on everything else. The grad program I’ve applied for is for helping folks. I guess I have a debt that is owed going forward.
