a short back and forth from GregInVT and pines of rome inspired a TL;DR comment that I decided to make into a diary, instead.
My diary will be slightly off-topic to Windtalker 's great diary. Seriously, click on the link above. Better diary than this one. At the top of that diary is a pic of Turtle that isn't as ugly as Donnie, but Mitch's abilities make him perhaps more dangerous than Donnie for a longer time.
Pappy Bush, Dubya, Donnie, Mitch, and the batshit evil Federalist Society have dumped a whole lot of miserable excuses for human beings in courts, where they dump a whole lot of misery on a whole lot of us.
Most recently, the Supremely Vile Six have put women in a very dangerous hole by chopping out a huge part of their essential healthcare. But the Six are multitaskers at evil, so this 60 year old male in one of the safer demographics in America feels unsafe and very concerned about the people around me.
In the above cited comment thread, it was pointed out that we might actually get enough power to correct some of the judicial threat hanging over our heads. The political process of impeaching INjustices who lied to get on SCOTUS seems impossible. Next best would be to expand the SC.
I would like to list a best case scenario that hopefully would at least partly come true.
1)Expand the Appellate Court from 13 circuits to 15, in order to speed up the overworked courts and to dilute the Federalist Society hacks.
2)Expand SCOTUS to 15, with one justice for each circuit able to issue a temporary stay that would have to be justified to a preassigned panel of 3, 5, or 7 justices to put the matter in the process for admission to the SC docket. This would greatly reduce the ability of fascist organizations like the Federalist Society and ALEC to venue shop Appellate circuits or SC justices with state laws carefully crafted to let the Supremely Vile Six warp microscopically related cases into nationwide rulings.
3)No more shadow docket. Every ruling has to have transparency.
4)Mandatory retirement after 18 years on SC or Appellate Court, maybe with a cumulative total of 24 years if a SC justice had served on the Appellate Court. Eliminate the lifetime appointments that make justices an unaccountable nobility. Because of Article 3, Section 1 of the Constitution, retirement might have to be lifetime full salary pensions. Small price to make the courts responsive to the will of the people.
5)Written rules on ethics and forced recusal, since there would be plenty of justices left.
Yeah, perhaps I am overly hopeful, but better to aim high and get something than to aim low and get nothing.
