CNBC is reporting here that John Eastman took the 5th when making grand jury testimony in Georgia. He also claimed attorney-client privilege (which, as is often noted here, does not apply to attorney advice or participation in performance or planning of a criminal act).
Unsurprisingly, Eastman’s attorney claimed political harrasment:
“By all indications, the District Attorney’s Office has set itself on an unprecedented path of criminalizing controversial or disfavored legal theories, possibly in hopes that the federal government will follow its lead,” the lawyers said.
I would presume by “disfavored legal theories” the attorneys mean bogus legal theories to allow individuals to perform illegal acts to overturn an election. I guess that means any legal theory drawn up in crayons saying ‘I want that more than you do is an acceptable basis for taking someone’s money” is defensible attorney-client communication.
