TFG has shown no compunction to defy social, political, and legal norms. His behavior has flummoxed everyone trying to pin something, anything on him. TFG successfully operates in the gray, unknown void beyond social, political, and legal rules. For example, even before being elected, TFG refused to release his tax returns. There is no law specifying that candidates or Presidents need to release their tax returns. It is a practice established by George Romney in 1968 (oh, Gerald Ford also didn’t release his tax returns but [weak excuse] he never ran for President, much less Vice President). Lately, TFG has monetized his skirting of norms, claiming victimhood (WITCH HUNT!!) for every recent effort to hold him accountable (I never realized there were so many witches in the Republican Party).
So, what makes his potential candidacy for President in 2024 any different? Oh, the 14th Amendment? The Jan 6 Committee has no power to prosecute the “crimes” outlined in the 14th Amendment. This is the DOJ’s purview. Will the DOJ pursue this? There needs to be quite the evidence for DOJ attorneys to do so (losing looks bad for the DOJ) and there will be legal pushback from TFG. Is there a document in TFG’s handwriting (or typed with his written signature at the bottom) demanding that the Proud Boys and/or the Oath Keepers begin assaulting the Capital?
Despite Merrick Garland having revealed his new balls, does he expect that he can successfully prosecute TFG for taking documents to Mar-a-Lago that didn’t belong to him? Already suspected HCS violations by TFG (one of the most grave national security breaches) have been ignored. Indeed, TFG is successfully litigating the removal of “his” documents from the White House. Will a Special Master spill the beans to TFG?
So, let’s have the nightmare that TFG wins the Presidency in 2024. We have the 14th amendment, right? Insurrection! Rebellion! We need 2/3 of each House of Congress to vote to remove TFG from the Presidency. Republicans. Really?
What about the 25th Amendment? Will a TFG cabinet vote to remove TFG from office (they didn’t the first time and now TFG is forewarned)? His VP? Congress (probably needs a 2/3 vote)? Remember, Republicans do have TFG’s base to consider. Even if TFG is removed and writes to the President pro tempore of the Senate and the Speaker of the House of Representatives that he is fit for office, will the cabinet and VP remove him again? If so, will 2/3 of either house of Congress vote that TFG is unable to discharge his duties as President and remove him from office? If he is removed, can TFG write yet another qualifying letter and, of course, litigate (which is not addressed in the Constitution) to try again for the Presidency?
Even if “removed” from office, will he actually leave or will he litigate? You get two guesses and the first one doesn’t count.
Even if successfully and physically removed from office, or even jailed, you know he’ll claim he’s still President and being victimized. Is it beyond imagination that Republicans will demand that TFG has the right to run as President again (even from jail)? If successfully removed from office after having won in 2024 (remember, we are still having our nightmare), will TFG demand (and litigate) his reinstatement to the office? Will he assert his right to run yet again in 2028 (if he’s still alive), justifying his run by having served only a partial term? Can you not believe that Republicans will support and echo all TFG’s demands? Can you not believe that TFG will litigate this as well?
What a nightmare.
