Maybe he wants to give you the classified documents he took from the White House.

Last week we learned that the FBI executed a search warrant at Mar-A-Largo, and seized 11sets of classified documents that Trump had taken to Mar-A-Largo when he left the White House in January 2020.

We should remember that in order for the FBI to have gotten the search warrant they would have had to submit an affidavit to a Federal Judge or Magistrate containing sufficient evidence to convince him that there was “probable

cause” to believe that a crime had been committed and that evidence of that crime was at Mar-A-Largo. Additionally we learned that Attorney General Merrick Garland had personally authorized the warrant application. We also learned that in June, Trump’s Attorney had given the DOJ a letter attesting to the fact that all classified material had been turned over to the DOJ. In spite to that representation, a confidential informant later told the DOJ that there were more classified documents stored at Mar-A-Largo. In such case the warrant application would have had to contain sufficient factual information to convince the Federal Judge/Magistrate, and AG Garland that both the informant and the information were reliable. That is, whether the informant was in a position to have personal knowledge that the classified documents were, in fact, at Mar-A-Largo, and that they were still there.

Therefore I believe it is safe to conclude there was sufficient evidence of criminal wrongdoing to justify the search and the seizure of documents.

Thus, the FBI and DOJ now have “probable cause” to believe specific crimes have been committed and they have sufficient documentary evidence to prove the crimes were, in fact, committed. Additionally, it is undisputed that Ex-President Trump was lawfully responsible for removing the documents from the White House and having them transported to Mar-A-Largo, which is itself a violation of federal law. Indeed, Trump has publicly admitted he possessed the documents, and now has demanded they be returned to him.

All that remains now, is for the DOJ to impanel a Grand Jury and submit the evidence to the GJ and request an Indictment be issued charging Trump with committing the specific crimes spelled out in the Search Warrant. Of course, the GJ would have to hear sworn testimony from the FBI agent who applied for the warrant, the confidential informant, an expert on the law regarding classified documents, and any other individual who possesses material and relevant information regarding the matter.

Once the Indictment is returned by the GJ the DOJ will probably notify Trump and his Attorneys that Trump has been indicted, and arrange for his surrender, and appearance before Federal Court to be arraigned.

We are all waiting for Garland and the DOJ to act. Will it be today, tomorrow or next week, when, that is the question.
