Josh Marshall — who’s political instincts are as finely tuned as anyone we all have regular access to — had this to say about Raid-a-Largo:
“…. this is key. there’s no way Garland, by the book and cautious to a fault, is going to authorize *this step* over boxes President wasn’t authorized to take and later returned. this was certainly something else, involved important evidence that possibly wld otherwise disappear.”
I disagree and while I will not say my disagreement is 100%, I’m reasonably certain that Garland is playing the long game here.
If you get a conviction or guilty plea (more likely) on the ‘clear as day’ violation of federal law for the mishandling of White House documents - the orange one is DQ’d from federal office. Once that is in place the defense against everything else - ‘they’re doing it for political purposes’ - evaporates as there is no future political role for the orange one to play; he’s ineligible.
That landscape makes all the insurrection-related charges to follow (whatever their volume and scope) far less incendiary and (as previously noted) no longer even loosely defensible with the political element (current / future federal candidate) in the rear view mirror.
I think the timing is critical as well, as the GOP - if they get the House - might look to shield Trump (among other crazy-town reasons) by making him Speaker as early as January, 2023. See Matt G., Jim J., Louie G., et al.
If that gets a vote in a new Congress what crew in the future House GOP is going on the record as a “no” vote. So timing is important here.
Side note —
if the GOP were to take the House and they do make Trump Speaker — and I can’t believe I’m doing this casino theory exercise on-line here — what are the odds that the threat level from assassination to Biden and VP Harris is raised exponentially?
