A young girl who’s been raped typically finds out she’s pregnant six weeks later. At that point the embryo bears a close resemblance to a tadpole, but it’s much smaller, about the size of a pea. About the only biology it has in common with a born human being is its genetics. Yet red-state legislatures everywhere are forcing raped girls to carry the embryo to term. Their only justification is the religious belief that “personhood” begins at conception, when the fertilized egg acquires a soul. But the Constitution expressly forbids government from forcing such beliefs on those who do not share them. The proponents counter-argue that only rights specifically iterated in the Constitution are protected. But surely there are other human rights worthy of protection? And didn’t the founders list a few of them in the Declaration of Independence, when they referred to“certain unalienable Rights, that among these are Life, Liberty and the Pursuit of Happiness?” Aren’t “unalienable” rights as “fundamental” as rights can be? And if so, isn’t forcing a girl to carry the product of rape to term a profound, and quite possibly permanent, infringement on her right to pursue happiness? And if it isn’t, what pray tell is?
