We the People needs to be all of the people...
In 2000 a group of five people exerted their will to override the will of the people, now their successors seek to do that and more. Their goal is to remove the unenumerated constitutional rights while redefining the enumerated rights in a way that cripples them in order to return the United States to a point it was at more than a hundred years ago.
I took an interest in our Constitution after George W. Bush became president by fiat rather than democracy. As I dug deeper into our rights, I discovered that there are more than two dozen rights that we take for granted that actually are not in the Constitution proper but inferred (unenumerated) from the other declared (enumerated) Rights. These Rights are not esoteric concepts but Rights we take for granted every single day; things as simple an yet essential to our society such as privacy, travel, education, healthcare and safety, intellectual freedom, property, Social Security, healthcare and even voting.
Until the recent Dobbs decision by the Supreme Court, the idea that these Rights could be stripped away seemed like an concept in speculative fiction like The Handmaid’s Tale, but Clarence Thomas’ concurring opinion accompanied by proposed laws in several states that seek to make Orwell’s 1984’s thought crimes a reality have shaken me to the core of my being.
Add in the horror of the January 6 Insurrection, and our Democracy and freedoms are not at risk just in theory, they are under a full frontal attack from those who want power and dominion above all at the expense of the future of the United States. If we want to avoid become the balkanized countries in found in Heinlein’s Friday, we need to take action now.
I am by no means a lawyer or a constitutional scholar, and my qualifications are just that I have taken classes on the Constitution, governance, ethics, history, and social justice on my way to my bachelor’s degree. I have also read scholarly articles on these subjects, historical reasoning behind them, and how the United States has approached and implemented or not implemented these ideals and concepts. I have looked at the international compacts on Rights that the United States has put forth and seen how we have encourage other nations to adopt these Rights, while we ourselves have often not adopted them an even tried to weaken those Rights in our own nation.
Its taken me more than fifty years to figure out what I want to do in my life, but this is it. We need to become better — a better People, a better Community, and a better Nation. We need take the lead back as a true innovator of freedom and a global leader and example the light the way for all people. I want to help do this, but the first thing I need to do is actually put myself out there, and this is me doing that now.
I know this may subject me to ridicule or attack from certain parts of our society, but I need to do this for the future of my kids, nieces and nephews, and their future children.
So Here I go.
The Rights we have but don’t have.
Over the last twenty years my research has taught me that there are multiple Rights that we have that are not guaranteed, as Dobbs, Clarence’s concurrence, and the resulting movement by states to build on it have quite clearly shown us. The recent moves by states to restrict movement, the holding and distribution of ideas, privacy, healthcare are examples that I had never thought would ever come to bear here in the United States, but here we are.
So what are those rights? Here are the base rights that form what is a Second Bill of Rights:
The Right to our Rights (This is a wonky one but, so very important, that is why it is first) The Right to Security of the Self The Right of Privacy The Right of Intellectual Freedom The Right to Equality and Equity (ERA+) The Right to Education The Right to Health and Healthcare The Right to Social Security The Right to Property The Right of Movement The Rights of Legal Entities (More important than you realize) The Right to Vote in Fair Elections The Right to Open and Ethical Governance
Within these core rights are these important Rights:
The Right to Information
The Right to Freedom of Association
The Right to Citizenship
The Rights of the Child
There other ideas that are inferred by these rights that need mentioning as well, and I intend to comment on them.
This is literally my first attempt to ever put myself out there, and as a noob I will make mistakes. My first attempt at putting this out there earned me a C+ from in my Constitution class, and I have made some changes and tweaks to this since then. I hope to see you again next week.
