We have had public criticism from Congress (Adam Schiff) and the media (Chris Hayes and Mehdi Hassan) that Merrick Garland’s Department of Justice is taking too long to focus on the political actors that called the mob to the Capitol on Jan. 6. I believe that this is counterproductive. The Biden Administration has a number of terribly serious problems to solve, and for one thing, the carping undermines the Administration’s political capital. For another, I think that it is just wrong-headed.
The January 6 committee has established that on December 18, Donald Trump learned that no governmental process was going to secure his presidency. Around 1 AM on December 19, Trump sent a text message that galvanized the organizers of the violent mob that stormed Congress during the ceremonial certification of Biden’s election.
If the organizers of that mob — the leaders of the paramilitary Oath Keepers, Proud Boys, and Three Percenters — did not exist, then nothing happens on Jan. 6. That they continue to operate and inspire others to organize for similar ends in states around the country is the biggest threat to our democracy. The members of the GoP that lean into that power base — including Ron Desantis — must have that tool stripped from them.
Garland is doing the work of making certain that the members and organizers of the paramilitary organizations receive that feedback. Engage in violent insurrection, and you will spend the rest of your lives in jail. This must be the first order of business for the DoJ.
But consider further: what if the DoJ has circumstantial evidence that the leaders of paramilitary organizations were contacted by an unregistered mobile device in Washington D.C. in the hours just prior to issuance of Trump’s tweet? What if Trump had actually called them to testify that his own Administration had betrayed him and was told “We’ll take care of it for you, Donald!”? Then the whole business about the Big Lie and Fox News and fraudulent electors and hair dye is irrelevant. The only thing that matters is getting one of the principals in the assault on Congress to testify that that caller on that unregistered line was, in fact, Donald Trump.
So just cool your jets people. It’s not about you. Trust in the process.
