Can I Sue my zygote?
Full disclosure, IANAL. As you will see. And I am livid enough that I might be a bit incoherent. Full disclosure. And more than anything, this is a rant. If there does happen to be something in here of possible value, I am at most, just plain grateful.
So. That said —
Can I sue my zygote?
When the state declares that
>> my zygote is a full person «
with all of the rights that go with personhood,
where do its responsibilities lie? Full personhood implies responsibilities. If corporations are people and they have rights and responsibilities, and zygotes are people then they also have responsibilities as well as rights, just as I have responsibilities and hopefully at least as a human person I do have some rights?
If my neighbor’s child throws a rock at me by accident, and I am injured, I can still sue that child, right? (Granted it would go to the child’s parents but in the documents, the child would be named as being at least one defendant — is my understanding. and IANAL)
If zygotes or embryos or fetuses are declared Persons, with all the rights thereof, then can we sue them?
If I am pregnant against my will, can I sue it for wrongful detention or kidnapping or coerced servitude?
Can I sue it for holding me hostage?
Can I sue it for wrongful death if it kills me?
Could I sue this zygote for domestic violence if it is a tubal pregnancy? Or any other damage it might do to me? Or to my heart rate or to my bloodstream or to my immune system or any other part of my physicality? My back, my knees, any part of my physical body that it might injure directly or indirectly?
Can I bring charges against it for assault or battery if it causes me physical injury?
Can I sue it for costing me three years of my college education?
Can I sue it for equal pay for equal work?
Can I sue it for depriving me of my constitutional right to life, liberty, and pursuit of happiness ? (— since this pregnancy deprives me of my freedom, and interrupts my pursuit of happiness).
Can I sue it for defamation of character if it makes it hard for me to get a job?
Can I sue it for the $xxx,000 that it costs me to raise that child?
Can I sue it for the $50,000 that it cost me for medical care while I’m pregnant?
Can I sue it for lost wages?
And even if I can sue the zygote for these things, can I also sue the sperm donor for any and all of the above?
Can I also sue whoever or whatever coerced my confinement? whoever or whatever coerced wrongful detention? whoever or whatever coerced servitude, kidnapping, false imprisonment, involuntary servitude, or coercive threat? ("the use of express or implied threats of violence or reprisal (as discharge from employment) or other intimidating behavior that puts a person in immediate fear of the consequences in order to compel that person to act against his or her will.")
And/or can I sue the judge or court that requires this of me, as being responsible for this unreasonable servitude or coerced servitude? For Unlawful detention? kidnapping? holding me hostage?
would I have to take it to the world court? Is it a terrorist act against my female humanity?
Can I sue my zygote for equal pay for equal work, for X months or years of 24/7 childcare, Without even the benefits of being an indentured servant?
The 13th amendment says that involuntary servitude is only allowed if you were lawfully convicted of a crime.
So if I am pregnant, and I am subjected to the involuntary servitude of gestating this baby to term, what crime is it that I have I been lawfully convicted of? Being a woman?
What gives the state the right to imprison me and coerce me to do something if I have not been lawfully convicted of a crime?
I know there are laws to wear seatbelts and pay taxes, but they do not affect personal autonomy. No person can be legally required to buy a car. No person can be legally required to… oh, I don’t know, eat tomatoes? We can’t even get people legally required to get the vaccine.
It seems like a stark contrast, that anti-abortion laws and zygote personhood laws are requirements TO DO something to or with another person. — Not to not -do something.
“Thou shalt not kill“ does not require me to live with my presumed victim and permit it to govern my every move, food intake, alcohol intake, preference to smoke or not, medical treatment or not, etc. I.e., all the things that are basically required of a pregnant woman in order to birth a healthy baby. (And if I fail at any of those kinds of things and there is a spontaneous miscarriage, then I am presumed to be guilty of murder?)
I have no answers. I am not a lawyer. But I am one hell of an enraged woman. I am far past child bearing years but I am still overwhelmingly enraged and indignant at the meta-rape that these laws represent.
These laws commit a staggeringly mindnumbing offense.
These laws pit the mother against her unborn child.
That in itself is some kind of crime although I don’t know what the name of that crime would be… Except that the previous administration excelled in pitting one group against another.
How can it possibly be in this country‘s best interest — or in the best interest of morality!! —
to pit a woman against her own body?
To pit a woman against her own unborn?
and even pit a woman against her own ovaries and eggs?
And not to speak of pitting a woman against her man or him against her.
this law pits a 10-year-old against her mother. This law pits a mother against her 10-year-old. This law destroys family relationships, but those who push this law say they are “protecting“ family?! “Family values”?!
This law is divisive of maternity itself; divisive of committed relationships; divisive of familial relationships; divisive of medical relationships; and of healthcare in general.
This law is obscene and will one day be found to be completely and totally flat out illegal.
