Everyone here knows that the current radical and reactionary court is a threat to our lives, our freedom, and our Democracy. One needs look no further than the deaths on the way from the forced births they are inflicting on women, to the recent rulings on Guns and Climate Change to see these lunatics are going to get a lot of people killed.
In addition to that, our nine overlords have agreed to hear an upcoming court challenge in the next session, on the so called, independent state legislature theory. You know the one that says state legislatures can throw out the states vote and award the electors to whomever they damn well please. The one that gives them the right to gerrymander to their hearts content despite lower court rulings on what is legal via a State’s Constitution. Because you know Roe should be determined by Democratic processes. As long as the vote is nice and rigged that is.
Also, don’t forget the when the court overturned Roe they basically destroyed the right to privacy that was used to legalize Gay Marriage, contraception and the right to interracial marriage (which I’m sure Thomas will actually protect). So a lot more horror is on the way. And if you think the Abortion rights Act and Voting rights act we’d pass if we won are safe from these maniacs I’d love to sell you some bridge-front property I own in New York.
In short, Democrats are going to have to do Court reform whether they like it or not. Otherwise, this court will likely strike down any laws we pass to undo the damage the right has inflicted on us, while upholding any laws, Republicans pass to restrict and keep us down.
Given that the world they envision for us is not a pretty one, and not one I want to live in, something has to be done. Luckily a lot of smart people have mapped out numerous ways, the power of the court can be curtailed. From congress limiting their jurisdiction, to age limits, to term limits for the court. There are a number of avenues to explore. But my favorite of course, is good ole fashion court packing.
I like this solution for a number of reasons but mostly because it seems, once it is done it is done. Republicans can’t unpack the court. They can pack it even more if they want though, to which I say fine! The more people on the court the merrier. The more likely there will be things like compromise and sanity in the rulings. it also would mean more turnover, due to age sickness etc.. What I’m sayin is a court packing arms race doesn’t scare me. Because, no matter what, the more justices we have the less likely we are to be ruled by nine crazy people. From my perspective if we pack the court as opposed to other methods the less likely it is Republicans can undo it.
Now one of the questions one might ask if we do this is, how many judges should we go for? Well as you know from the title of this piece (I really killed the suspense with that didn’t I?) 13 seems like a grand number. Now as a disclaimer I’m no legal expert, but there are 13 District courts in the U.S. So it seems like the case to make for the American people is that we need a justice for each District court. We need 13 Supreme court Justices in order to have a fair system in the U.S. We could argue 9 is just too small a number given the court layout! Nine is just too small given the size of the country. We could argue it is been ages since we expanded the supreme court and the current court is just not equipped to deal with modern problems. Of course, and I have to give credit to pbrody16 in the comments for this, we could also argue 13 judges represents one for each of the original 13 colonies. What is more American than that?
I mean if the right can make up bullshit legal arguments like the imperial president, or independent state legislature theory, surely we can justify this. It doesn’t seem a reach to argue we need a judge for each district. And we certainly need some new judges in order to have something resembling an actual Democracy in this country. But that is Just my two cents. What do you think?
