The Supreme Court now needs fences!
Biden has the power to expand the court, provided the Senate can nuke the filibuster and he has a safe majority. Perhaps a big if. But it is still at least possible now, if a long way from being certain, that he could have a safe majority in the Fall.
White House press secretary Karine Jean-Pierre told reporters aboard Air Force One on Saturday when asked about such a reform. "That is not something that he wants to do." A fair question is why not? If by a minor miracle in the Fall he has the votes to both the nuke the filibuster and appoint more Supreme Court Judges, why in the world would he not do so?

Biden’s reasons are at this point up for speculation. Of course, the Republicans would be expected to do the same if they could. Which would further discredit the Court. Most recently, the Democrats failed by one vote in January to nuke the filibuster, which apparently has to happen before additional judges can be appointed. (51votes would also be required to appoint an additional judge, which is only possible if the filibuster is nuked.)
Biden may be saying now that he wouldn’t expand the Court, but you wouldn’t expect him to say anything else at this point anyway since he does not have the votes to remove the filibuster rule. I think it’s important to attempt to understand why we still have the filibuster rule and why it so heavily favors the Republicans. It serves as a paralyzing “truce” between the party’s which mirrors the split in the country. But that truce has been broken by the Republican fascists and stands in the way of legislation that most Democrats would like to see passed. Is the Democratic leadership so afraid of what the Republicans would do if they were not deterred by the filibuster that they prefer a dysfunctional Congress?

I think it’s no longer an issue as to not nuking the filibuster given the current tyranny now being practiced by the Supreme Court six. This second fascist coup headed by this unholy six has matured to where its rulings can be used to do the fascists’ evil deeds independently of Congress or even a president.
They are proceeding unchecked to savage our Constitution and set up a fascist theocracy. While nuking the filibuster and expanding the Court are not without their own risks and consequences, I can see no other way to fight back. Popular fascist opposition can easily sink into demoralization if this becomes possible, but nothing is not done.
Fight Back or Lose Credibility
Perhaps the most famous KO in boxing. It came in a round and fight overwhelmingly won up to that point by Pacheo, who got knocked cold by a counterpunch by Marquez.
Indictment of the January 6th plotters are a much needed and positive step should it occur, but the unholy six must be stopped before they completely unravel the Constitution. Biden needs to be seen fighting back now, at this moment, however he can. Now and not just after the unpredictable mid-terms. Especially if he does not want to commit to expanding the court at this juncture.
Those of us familiar with boxing and martial arts know that huge blows like Roe v. Wade’s reversal also provide opportunities to counterattack. I know as a boxing fan that many KO’s come from counter punches that the opponent never seen coming. Knock outs sometimes come suddenly and can be unexpected. Biden needs to think, fight and act outside the box.
