The Supreme Court of Brazil will examine a new request for freedom presented by the defense of former President Luiz Inácio Lula da Silva, a prisoner for alleged corruption, as determined by the investigating judge, Edson Fachin.

Fachin, who analyzes the cases of Operation Lava Jato (investigation for corruption), previously rejected other requests from the lawyers of the ex-representative.

However, he now requested the Attorney General’s Office to issue a ruling on the writ of habeas corpus presented by the defenders of Lula.

The magistrate communicated that he will take the case to the second room of the superior court, integrated by five magistrates.

Last week, Judge Sérgio Moro, who condemned Lula, invalidated his rejection of the policy and said yes to President-elect Jair Bolsonaro’s invitation to head the Justice Ministry in January.

In this new scenario, the defense of the former head of state filed before the Federal Supreme Court a new habeas corpus, in which he asks for his release after Moro’s political bias becomes apparent.

Through a statement, the lawyers of the former labor leader explained that with this action they seek to obtain the nullity of the process and the freedom of their defendant.

“Lula is the victim of a real judicial hunt by a robed agent who improperly used legal files to politically persecute a citizen, seeking to annul, one by one, their liberties and rights,” said the defense lawyers.

They stressed that ‘the judge (Moro) acted politically. During the electoral campaign, he maintained contact with the leadership of candidate Bolsonaro and during that period he was also facing the trial against Lula, who until August was leading the polls on intention to vote, heading for the presidential elections in October.
