Cuba retakes the post of Prime Minister

In the next few days, during the IV Regular Period of Sessions of the National Assembly of Popular Power in its 9th Legislature, Cuba will designate the Government of the Republic and will resume in its structure the position of Prime Minister, which leads to a higher step institutionality and directs the executive and administrative management of the country through channels of greater efficiency.

According to the Constitution in its Third Transitory Provision, «once elected, the President of the Republic, within three months, proposes to the National Assembly of People’s Power the appointment of the Prime Minister, Deputy Prime Ministers, the Secretary and other members of the Council of Ministers ».

In compliance with said constitutional mandate, in the next session of Parliament the Prime Minister will be appointed, who, in accordance with Article 140 of the Magna Carta, is the Head of Government of the Republic.

– How is the Prime Minister appointed?

The Prime Minister is appointed by the National Assembly of Popular Power, at the proposal of the President of the Republic, for a period of five years. To be appointed in this position the favorable vote of the absolute majority is required. «The Prime Minister is responsible to the National Assembly of People’s Power and to the President of the Republic, to whom he reports and reports on his management, that of the Council of Ministers or his Executive Committee, on occasions indicate ».

– What requirements are needed to be Prime Minister?

It is required to be a deputy to the National Assembly, to have reached 35 years of age, to be in full enjoyment of civil and political rights, to be a Cuban citizen by birth and not have other citizenship.

–What are your powers?

Comply with and ensure respect for the Constitution and laws; Represent the Government of the Republic; Convene and direct the sessions of the Council of Ministers or its Executive Committee; Attend and monitor the performance of the activities of the agencies of the Central State Administration, national entities and local administrations; Assume, exceptionally and temporarily, the direction of any agency of the Central State Administration; To request that the President of the Republic be interested in the pertinent bodies replacing the members of the Council of Ministers and, in each case, propose the corresponding substitutes; Exercise control over the work of the heads of the agencies of the Central State Administration; Provide instructions to provincial governors and control their execution; To adopt in an exceptional manner decisions on executive-administrative matters within the competence of the Council of Ministers, when the pressing nature of the situation or the issue to be resolved requires it, subsequently informing that body or its Executive Committee; Appoint or replace managers and officials, in accordance with the powers conferred by law; Sign the legal provisions adopted by the Council of Ministers or its Executive Committee and arrange their publication in the Official Gazette of the Republic; Create commissions or temporary work groups to perform specific tasks, and Any other attribution assigned by the Constitution and laws.

For its part, in accordance with the principles of the constitutional text, the Council of Ministers is the highest executive and administrative body and constitutes the Government of the Republic. It has a collegial nature and its decisions are adopted by the favorable vote of the simple majority of its members. In addition, it remains in office until the Government is appointed in the new Legislature.

–Who are the Council of Ministers?

The Council of Ministers is composed of the Prime Minister, the Deputy Prime Ministers, the Ministers, the Secretary and the other members determined by law. The Secretary General of the Central of Workers of Cuba participates in the sessions of the Council of Ministers.

–Who are your Executive Committee?

The Prime Minister, the Deputy Prime Ministers, the Secretary and other members of the Council of Ministers determined by the President of the Republic. The Executive Committee may decide on the issues attributed to the Council of Ministers during the periods between one and the other of its meetings. «The Council of Ministers is responsible and periodically reports on its activities to the National Assembly of People’s Power».

–What are some of your functions?

Organize and direct the execution of political, economic, cultural, scientific, social and defense activities agreed by the National Assembly of People’s Power; Propose the general objectives and goals for the elaboration of the short, medium and long term plans according to the economic and social development of the State, and once approved by the National Assembly, organize, direct and control their execution.

Direct and control foreign trade and foreign investment; Prepare the draft State Budget and, once approved by the National Assembly, ensure its execution; Implement and demand compliance with the approved objectives to strengthen the monetary, financial and fiscal systems; Prepare legislative projects and submit them for consideration by the National Assembly or the State Council, as appropriate; Provide national defense, the maintenance of security and internal order, and the protection of citizens’ rights, as well as the safeguarding of lives and property in the event of disasters; To direct the administration of the State, as well as to unify, coordinate and supervise the activity of the organisms of the Central Administration of the State, of the national entities and of the local administrations; Create, modify or extinguish subordinate entities or ascribed to the Council of Ministers and, as appropriate, to the bodies of the Central State Administration.

Guide and control the management of provincial governors; To execute the laws and agreements of the National Assembly of the Popular Power, as well as the decrees-laws and dispositions of the Council of State, the presidential decrees and, if necessary, to regulate what corresponds; To issue decrees and agreements on the basis and in compliance with current laws and control their execution; Propose to the State Council the suspension of the agreements of the municipal assemblies of the Popular Power that contravene the laws and other provisions in force, or that affect the interests of other communities or the generals of the country; Suspend the agreements and other provisions of provincial councils and municipal administration councils that do not conform to the Constitution, laws, decree-laws, presidential decrees, decrees and other provisions of higher bodies, or when they affect interests from other localities or the generals of the country, reporting to the Council of State or the Municipal Assembly of the Popular Power, for the purposes that may proceed as appropriate.

Repeal all or part of the provisions issued by provincial governors, when they contravene the Constitution, laws, decree-laws, presidential decrees, decrees and other provisions issued by competent bodies, or those that affect the interests of other localities or generals of the country; Repeal all or part of the provisions of the heads of organizations of the Central State Administration, when they contravene the higher standards that are mandatory for them; Create the commissions it deems necessary to facilitate the fulfillment of the tasks assigned to it;Appoint or replace managers and officials in accordance with the powers conferred by law; Submit the regulations for the approval of the National Assembly of Popular Power or the Council of State, and The other powers conferred on it by the Constitution, laws or entrusted to it by the National Assembly of Popular Power or the Council of State.
