Minnesota Supreme Court upholds permit-to-carry law

The Minnesota Supreme Court upheld the state’s permit-to-carry law, ruling against a Minnesota man who was arrested for carrying a loaded handgun in a backpack when he was pulled over by airport police in 2018.
Nathan Hatch was charged and convicted of carrying a pistol without a permit, but he argued Minnesota’s permit-to-carry law is unconstitutional. He argued the state law violated his Second Amendment right to bear arms.
The state Supreme Court disagreed and said the law does not impose unnecessarily difficult standards for a person to receive a permit. Moreover, it serves a public interest in regulating public safety, the court said.
“(W)e conclude that the permit-to-carry statute is narrowly tailored to serve the compelling governmental interest in ensuring public safety,” the court ruled. “Law-abiding citizens over the age of 21 need only show that they have passed a gun safety course and that they are not a danger to themselves or others to receive a permit to carry a handgun in public.”
Minnesotans can apply for permits through their local sheriff’s department, which must issue a permit if the applicant meets all the requirements and isn’t prohibited from possessing firearms.
Moreover, the court outlined a number of instances in which a person is not required to have a permit, including possessing “a pistol in one’s home, place of business, or on land that a person owns.”
A person can also carry and transport an unloaded handgun in a ‘closed and fastened case” in a car without a permit, or use one for hunting or target shooting.
