Update On Larry W. Giddings - March 1995
In January of 1993 I was paroled from the sentences given to
me by the State of Washington. At that time I (once again) became
a Federal prisoner. This time serving three consecutive 25 year
sentences (75 years). In March of 1993 I received a "Sentence
Computation Summary" stating that I would become "eligible" for
parole after serving 10 years, in 2003. This "Summary" also
informed me that the U.S. Immigration and Naturalization Service
(INS) had filed a "detainer" on me from Oakdale, Louisiana.
As of this date, March 1995, I have served 26 months of the
mandatory 10 years before my "eligibility" for parole. Everyone
must remember that "eligibility" merely means that I can go to
the Parole Board in 2003 and they are allowed to "consider" me
for parole at that time. Very few, if any, political cases have
actually received parole after the minimum. In fact, most have
been required to serve the maximum, or two-thirds, for a
"mandatory release." In my case, mandatory release arrives in 50
years from 1993. Therefore, in my case, it would be correct to
say that I must be in prison for 10 to 50 years before being
paroled. After 10 years it is up to the Parole Board if I am
released or not; until 50 years has passed, in which case they
must release me.
At any time between now and my release scheduling I am
within six months of being set free, the INS must be notified.
INS will then place me in the Immigration Detention Center in
Oakdale, Louisiana, where any possible hearings on my deportation
to Germany will take place. I don't foresee any hearings, so I
will be deported at the completion of the 6 months.
The only way for my sentence to change is by winning
something in court. I have nothing filed in court now and haven't
had anything in court since 1984.
In August of 1993 I was transfered to Lewisburg,
Pennsylvania per my request, in order to visit parents and
friends. I will be in Lewisburg for the foreseeable future.
