I think Lincoln's suspension of habeas corpus WAS declared unconstitutional
by Chief Justice Roger Taney (I guess this was just before Salmon P. Chase, or
is my Supreme Court chronology messed up again?) acting alone.  Seems someone

in Indiana was court-martialled, convicted, sued for a writ of habeas corpus,
which he got from Taney.  Lincoln ignored it.
   Whether or not the full Supreme Court would have agreed with Taney, I don't
know.
