Just heard a feature on "All Things Considered" that bears on the
questions we've been discussing. Two or three years ago, Time magazine
was going to print some excerpts from Gerald Ford's memoirs, which were
to be published by Harper, Row. The magazine Nation received a copy of
the excerpts, and printed them; Time then withdrew from its deal, which
caused Harper, Row to lose money. So they've sued Nation for copyright
infringement.
Nation agrees that the material was protected by copyright. However,
the "fair use" doctrine -- according to this feature -- protects the
right of news organizations to report significant news items *even* *if*
*they're* *otherwise* *protected*. Harper, Row agrees that this is
correct in principle, but claims that the excerpts printed were not
newsworthy, that the substance of the remarks had previously appeared.
The trial will continue for about another month.
