The digests  do  not exist  as authorized  publications.  If
pressed as to what they  are, one would probably have to say
"experimental use of  the ARPANET for personal communication
via re-distributed  electronic mail"  Thus the  digests  are
actually only an automated mechanism for individuals to send
mail to  a larger  mailing  list. As  such, I'd  guess  they
should  fall under  the domain  of "internal communications"
between research project  members authorized to use the net.
This means  that they are about in the  same league with the
notes  you have  in your  desk drawers.  Re-printing of such
material  for readers outside  the audience to  which it was
originally sent (or  others reachable via the ARPANET's mail
system and  authorized to use the  net) constitutes theft of
personal property.

It is  about the same as someone  sneaking into the Pentagon
and xeroxing the contents  of someone's desk and then giving
it to  the Washington  Post. That  is, there  was NEVER  any
intent to "publish"  involved in sending the material across
the net. At least no  more so than if one mailed everyone on
a digest mailing list a copy of the same letter via the post
office. I.e. no "public" presentation of the information has
taken place.
