It is well known that NIH was doing this research and possibly more we don't now about.

What makes you think it is illegal? I just read that in 2017 the NIH had resumed funding gain of function research that was paused in 2014.

Rand Paul and his ilk are a different issue.

This is terrible but this is not the issue here. Things like this probably happen in research settings.
