My guess is that putting that statement in an advertisement does not
establish that policy as a "ToS" for the board.  There's no indication
that a potential user has to AGREE to that as a condition of use.  It
*might* be different if there is a questionaire during the signup that
asks that specific question and requires you to answer, but just the
advertisement alone -- I think not.
